Terms of use

These terms apply when you use the Simaya app and buy an eSIM data plan in it. Please read them together with our privacy policy. Nothing in these terms limits the rights you have under consumer protection law.
1. Who we are
Simaya is provided by Esperanes LTD, company number 517155115, 144 Menachem Begin Road, Tel Aviv, Israel ("we"). Contact us at hello@simaya.app.
Simaya is meant for people aged 18 or over. Younger travellers may use it and buy plans with the consent of a parent or guardian.
2. How buying works
- You buy plans in the app with Apple In-App Purchase. Apple processes the payment, and Apple's Media Services Terms apply to it. Apple's Standard License Agreement applies to the app itself.
- We provide the service you buy: we create your eSIM, deliver it to the app and help you use it.
- Each plan shows its price in the app. Before you confirm, Apple's payment sheet shows the exact amount it will charge in the currency of your App Store country, including any taxes Apple applies. That is the amount you pay.
- A promotional code applies under the conditions shown with it, and can't be combined with credit.
- There are no subscriptions and nothing renews automatically. Each plan is a single purchase.
- If, after you pay, we can't provide the plan at the price you paid, we either deliver it at that price or refund you in full.
3. What a plan includes
- Mobile data in the destinations listed for the plan, for the data amount and number of days shown.
- Data only: no phone number, calls or text messages. Your usual line keeps your number.
- The networks listed for the plan. Speed depends on the network, your iPhone and where you are, and 5G is used only where the network and your iPhone support it. We can't promise coverage everywhere in a destination or a particular speed.
- Unlimited plans are daily passes. Each day includes the full speed amount shown on the plan, then continues at the reduced speed shown, until the next daily reset. The reset time depends on the network.
- When a plan starts. The plan's Key facts say when its days start counting. Most plans start when they first connect to a network in a covered destination; some start when installed. Each plan also has a deadline to start, shown in its Key facts. A plan not started by then expires unused.
- When a plan ends. When its days run out or its data is used up, whichever comes first. Unused data does not carry over. Top ups are not available; you can buy another plan.
- Personal hotspot is not confirmed for every plan. Where it works, it uses the plan's data.
4. Your iPhone
- You need an iPhone that supports eSIM and is not locked to one carrier. Please check before you buy. In the app, "Is this iPhone compatible?" shows whether iOS reports eSIM support; it cannot see a carrier lock. To check the lock, open Settings, General, About, and look for "No SIM restrictions" next to Carrier Lock.
- Each eSIM installs on one iPhone, usually only once. Each traveller needs their own plan.
- Don't delete an installed eSIM you still need. A deleted eSIM usually can't be installed again.
- The usage shown in the app is the latest report from the network and may be delayed.
5. Delivery and your order confirmation
After Apple confirms your payment, we prepare your eSIM. It appears in My eSIMs, usually within a few minutes, and you install it from there with Apple's eSIM setup. We recommend installing over Wi-Fi before you travel. If delivery takes longer, the app tells you, and if we can't deliver, we refund you in full (section 7).
The app keeps a confirmation of each order in Profile, Orders, with our details, the plan, the price, the date and how to cancel, which you can save or share.
6. Fair use
The plans are for your own use while travelling. You agree not to:
- resell a plan or share it commercially;
- use it in routers, dedicated hotspot devices or machine to machine equipment;
- use it for anything unlawful, to send spam or to attack networks;
- use it in a way the network treats as abnormal, such as continuous heavy use as a replacement for a home or local connection.
If a plan is misused, our supplier or the network may slow, suspend or end it, and we will tell you when we can.
7. Cancellation and refunds
Cancel within 14 days, before you install
You can cancel a plan within 14 days of buying it, or of receiving its order confirmation if that is later, as long as its eSIM has not been installed on a device. You get the full price back, with no cancellation fee.
To cancel:
- Ask Apple first. In the app, open Profile, Orders, choose the order and tap "Request a refund from Apple", or go to reportaproblem.apple.com. Apple decides on the request and refunds your payment method.
- If Apple declines, email hello@simaya.app with the order reference shown in the app and the purchase date. We will refund you directly, by bank transfer or another method we agree with you, within 14 days of your request.
When a plan is cancelled or refunded, we cancel its eSIM, and it stops working.
When something goes wrong on our side
If we can't deliver your eSIM, or it can't connect in a covered destination because of a fault on our side or our supplier's that we can't fix, we refund the full price, even if the eSIM is installed. Please contact us first so we can try to help. We may ask for a screenshot of the error, with any codes hidden.
When a refund isn't available
Except for a fault on our side or where the law gives you a right, we don't refund a plan after its eSIM has been installed, after the plan has started, or after it expired unused because it was not started by its deadline. These are not faults on our side: an iPhone that doesn't support eSIM or is carrier locked, settings such as Data Roaming turned off, a deleted eSIM, use outside the plan's destinations, or speeds within what the plan describes.
When Apple refunds you
If Apple refunds a purchase, for any reason, we cancel the eSIM that it paid for. Refunds return money, not credit; credit used on a refunded order comes back as credit (section 10).
8. Support
Email hello@simaya.app. Our support page and the Help center in the app explain installation and the most common problems; the app's guides work offline.
9. Your account
- Signing in is optional. You can buy and use plans without an account.
- Use one account for yourself, and keep your sign in method secure. Tell us at once if you think someone else has used your account.
- You can delete your account at any time in Profile, Account details. Deleting it forfeits your credit. It doesn't cancel eSIMs you already have or refund orders.
- We may suspend or close an account used for fraud or misuse or in serious breach of these terms. We will tell you why when we can. Plans you paid for stay yours, unless they were obtained by fraud.
10. Credit, cashback and referrals
Credit is available when you're signed in.
- Cashback. Each eSIM you buy earns credit worth 10 percent of the price you paid, excluding VAT and other taxes, rounded down to the cent. It becomes available when the eSIM is delivered, unless the app shows a later date for it.
- Buying before you sign in. If you buy without an account, sign in on the same iPhone to add the credit that purchase earned, whenever you do.
- Referrals. A friend who enters your referral code in the app before their first paid order gets 5 US dollars of welcome credit for a first eSIM of 10 US dollars or more. You get 5 US dollars of credit once their first eSIM of 5 US dollars or more has been delivered, available as shown in the app. A code can be entered once and not by its owner. Referral credit is limited to 20 friends in 30 days and 100 friends in total.
- Using credit. Credit lowers the price of a plan of 5 US dollars or more in the app, on an iPhone linked to your account. The app shows how much credit applies before you pay. We may apply less than your balance, so that the charge stays at or above a minimum amount, and Apple then charges the lower price.
- Credit is not money. It can't be paid out, transferred, sold or exchanged for cash, and it has no value outside the app. It doesn't expire while your account is open.
- Refunds. If an order is refunded or cancelled, the credit used on it comes back to you as credit, and the credit the order earned, including the referral credit it earned for the person who invited you, is taken back from the available balance.
- Misuse. We may withhold, reverse or cancel credit obtained by misuse, such as one person using several accounts or devices, or referrals that are not real friends.
- Changes. We may change the program, including its amounts, for the future. If we end it, we will say so in the app, and credit already available stays usable for at least 30 days after that notice.
11. Changes
We may change plans, prices and features for future purchases. If we change these terms, the version in force when you bought a plan applies to that plan, unless the law allows otherwise. We publish each version here with its effective date.
12. Our responsibility
We provide the service with reasonable care and skill. We are not responsible for the coverage, outages or speed of local networks beyond our control, for problems with your iPhone, or for losses we could not reasonably foresee. Our total liability for a plan is limited to the price you paid for it, except where the law does not allow such a limit, for example for harm caused by our negligence. Nothing in these terms limits your rights as a consumer.
13. Law and disputes
Israeli law applies to these terms, and the competent courts in Tel Aviv-Jaffa have jurisdiction, without taking away the protection of mandatory consumer law that applies to you. If something goes wrong, please write to us first; most problems can be solved quickly.
